1. Introduction and Acceptance

These Terms of Use govern access to and use of the Mistly mobile application (the "App"), developed by Berkay Atik trading as Mindnull Studio (the "Developer", "we"). By downloading or using the App, you confirm that you accept these Terms, the Privacy Policy and, if you use Explore, the Community Guidelines. If you do not accept them, do not use the App.

2. What Mistly Is

Mistly applies a look to a photograph you provide. You pick a photo from your library or take one in the App, choose a look, and the App produces an edited version of it.

The App also offers a collage tool that composes several of your own photographs into one sheet, and Explore, a public wall where you may choose to publish a finished look.

Mistly does not supply photographs, does not search for or download images from anywhere, and holds no catalogue of its own. Earlier versions offered a camera with live filters; that feature has been removed. The camera now exists only to take a source photograph in place of picking one from your library.

3. Eligibility

You must be capable of forming a binding contract and must meet the age requirements of the App Store in your country. Mistly is not directed to children under 13, or the higher minimum age required where you live. Minors may use the App only with the involvement and agreement of a parent or legal guardian.

4. Your Photographs and Your Responsibility

• Full ownership of the photographs you provide remains with you. The Developer claims no rights over them.
• You are solely responsible for holding the rights necessary to use, edit, export and — if you choose — publish any image you load into the App.
• You must have the consent of any identifiable person appearing in a photograph you publish to Explore.
• Mistly acts only on your instructions. You agree not to use it to infringe anyone's rights or to break the law.

5. AI Looks

An AI Look is produced by a third-party model. You should understand what that means before you rely on it.

• The result is a machine-generated edit, not a photograph of something that happened. It may alter faces, bodies, surroundings and detail. Do not present a generated image as an unedited record of reality, and do not use one to deceive, defame or impersonate.
• Output varies. The same photograph and the same look can produce different results, and a result may be unusable. This is inherent to generative models and is not a defect.
• You keep what you make. We claim no ownership of the images you produce. Your use of a result is also subject to the terms of the provider that generated it, named in the Privacy Policy.
• A look may be refused. A request may be declined by us or by a provider where it appears to breach these Terms, the Community Guidelines, or a provider's own policy.
• Before your first AI upload the App asks for your explicit consent and names the providers involved. You may decline and keep using everything that runs on your device.

6. Explore and the Community Guidelines

Explore is a public wall. Publishing is optional and requires signing in.

Anything you publish must follow the Community Guidelines, which form part of these Terms. In summary: you may report a post or a comment, you may block another account, you may delete your own post at any time, and content that is reported enough times is removed automatically.

Posts on Explore are deleted 24 hours after publication, along with their images and comments. Explore is not storage and must not be relied on as a place to keep anything. Keep your own copy of work that matters to you.

We may remove content, restrict publishing, or end access to Explore where these Terms or the Community Guidelines are breached.

7. Acceptable Use

You agree not to reverse-engineer or decompile the App; circumvent its security; attempt to bypass purchase verification, credit accounting or device-integrity checks; automate requests or otherwise draw on paid capacity beyond ordinary personal use; create or distribute infringing or unlawful material; or commercially exploit or resell the App.

8. Premium, Credits and Purchases

8.1 How access works

Running an AI Look consumes credits. Every user receives a number of free credits each calendar month without paying anything. A premium look consumes more credits than a standard one; the cost is shown before you run it.

Credits are charged only after a provider returns a result. A failed generation does not consume credits. The balance is held on our server, not on your device, and it is the server that charges it.

8.2 Premium

Mistly Premium is an auto-renewing subscription, offered in weekly, monthly and three-month terms. It grants a larger credit allowance and removes the export watermark.

• Payment is charged to your Apple Account when you confirm the purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; the renewal charge is taken within the 24 hours before the period ends.
• Prices are always shown in your own currency, taken live from the store. Nothing is hardcoded.
• You can manage or cancel at any time in your App Store account settings. Cancellation stops future renewals; the current period continues.

8.3 Free trials

Where a free trial is offered, its length is shown before you confirm, and it is offered only where the store confirms you are eligible. Unless you cancel at least 24 hours before the trial ends, it converts automatically into a paid subscription at the price shown.

8.4 Credit packs

Credit packs are one-time purchases, not subscriptions. They do not renew and do not expire. Buying a pack does not grant Premium.

8.5 Refunds

Payments, renewals, refunds and billing disputes are handled by Apple under the App Store Terms of Service; we cannot process them on your behalf. Validation and synchronisation of your entitlement are managed by RevenueCat.

Credits already spent on a completed generation have been used to buy capacity from a third-party provider and are not refundable by us.

9. Exporting

• Free exports are written to your library at 720p on the long edge with a small watermark.
• Premium exports are clean and at full resolution, capped at a 4K ceiling and never upscaled — a result is exported at whatever resolution it was actually produced at, and the label reflects that honestly rather than claiming a size the file does not have.
• Collage exports are always clean and ungated. A picture you composed out of your own photographs is yours, and we do not watermark it.

10. Licence and Intellectual Property

The Developer grants you a personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, subject to the Apple Media Services Terms and Conditions. All intellectual property rights in the App, its design, its look definitions and its branding remain with the Developer. Open-source notices, where applicable, are available within the App.

11. Third-Party Services

The App relies on Google (Firebase and Google Cloud), fal.ai, OpenAI, RevenueCat and Apple. Your use of those services is also governed by their own terms; how they handle data is described in the Privacy Policy. The Developer is not responsible for the acts, omissions or content of third parties.

12. Availability and Changes

We may add, change or remove features, adjust credit costs and allowances, change which providers serve a look, or stop supporting older versions of iOS and older devices. Where a change removes something you have paid for, we aim to give notice in the App. We do not guarantee uninterrupted or error-free operation.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that generation will succeed, that a result will meet your expectations, or that the App will work on every device.

14. Limitation of Liability

To the fullest extent permitted by law, the Developer is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or images, arising from use of the App — including a failed generation, a removed Explore post, or an image lost from your device. Keep your own backups of anything that matters to you.

Nothing here excludes or limits liability that cannot be limited by applicable law, including liability for death or personal injury caused by negligence, or your statutory rights as a consumer.

15. Termination

You may stop using the App at any time by uninstalling it, and you may delete your account from Settings → Delete account. We may suspend or end access in the event of a material breach of these Terms or unlawful use. Provisions that by their nature survive termination — ownership, disclaimers and limitation of liability — remain in force.

16. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The mandatory consumer-protection rights of your country of residence are unaffected. Nothing here overrides the mandatory provisions of the Apple Media Services Terms and Conditions.

17. Changes to These Terms

Revisions are reflected in the "Last Updated" date above and published at this address. Continuing to use the App after changes take effect constitutes acceptance.

What changed in this version (8 September 2026)

• Section 2 was rewritten. Earlier Terms described Mistly as a camera with live filters. That feature has been removed; the App is now an AI Look editor with a collage tool and a public wall.
• Section 5 was added, covering what an AI Look is, that output varies, that a result must not be passed off as an unedited photograph, and that a request may be refused.
• Section 6 states how Explore works, including that every post is deleted after 24 hours.
• Section 8 was rewritten around credits: monthly free credits, premium looks costing more, and credits being charged only after a successful result.
• Section 9 sets out the export tiers, including the watermark on the free tier and the absence of one on collages.
